From the procedural report of the BBNJ Preparatory Committee, 31/07/17 :

The text would set out how decisions on matters related to area-based management tools, including marine protected areas, would be made, including who would make the decision and on what basis.

The text would address the question of the involvement of coastal States adjacent to an area for which area-based management tools, including marine protected areas, are proposed.

From the President's aid to discussion, 25/06/18:

(a) Taking into account possible approaches as indicated in 4.3 above, with respect to decision-making and institutional set up:

(i) What modalities for decision-making on matters related to area-based management tools, including marine protected areas, would be specified in the instrument?

(ii) What provisions, including any institutional arrangements, would the instrument include to give effect to the proposed allocation of responsibility for decision-making on matters related to area-based management tools, including marine protected areas?

(b) On what basis would decisions be made, with a view to enhancing cooperation and coordination, while avoiding undermining existing legal instruments and frameworks and the mandates of regional and sectoral bodies?

(c) How would the instrument reflect the involvement of adjacent coastal States in the decision-making process?

Suggestion 1: Global decision-making body[edit | edit source]

A global decision-making body could be empowered under the new instrument to identify, consult on and adopt protective measures for MPAs.

Suggestion 2: Decision-making that does not require consensus[edit | edit source]

Decision-making processes strive for consensus but do not require it.

Suggestion 3: Endorsement of MPAs established at regional level[edit | edit source]

Create mechanism for proposals for endorsement of MPAs established at the regional level (outside the framework of this agreement) to be submitted to the decision-making body for review.

Upon the entry into force of the agreement, the decision making body/COP and/or subsidiary body would promptly review existing regional MPAs with a view to endorsement, in cooperation with relevant sub-regional, regional and sectoral organizations and bodies.

Suggestion 3: Inscription on list of MPAs[edit | edit source]

MPAs adopted or endorsed pursuant to this agreement would be added to a list of internationally recognized MPAs.
