IX. Non-Parties

Non-Parties could be encouraged to become parties to the instrument.

States that would not be Parties to the instrument would not be discharged from their general obligations under UNCLOS and customary international law, including the obligation to protect and preserve the marine environment as well as the obligation to cooperate in good faith, and to ensure that their activities do not undermine the effectiveness of the instrument’s conservation measures.

The relevant rules of the Vienna Convention on the Law of Treaties would apply.
